1. Getting Started
Contacting Exling.If you have any questions, complaints, or concerns about our privacy policy, contact our support and service staff through the customer service and help links located on the bottom footer of our site at any time.
Scope. This privacy policy covers all of Exling and Exling Pro, hereby referred to as "Exling". It does not, however, apply to entities that Exling does not own or control, such as 3rd party websites and applications that may use Exling's API. All users that utilize 3rd party products interfacing Exling should do so only after reviewing and agreeing to the 3rd party's privacy policy. Exling API may facilitate sharing of information from Exling to the 3rd party programs which will require your username and password with Exling, after which time your information will no longer be under management and privacy from Exling. By using or accessing Exling, you agree to our privacy practices contained herein.
This site is rated "T" for Teen in content. If you are under age 13, please do not attempt to register for Exling, participate in any Exling applications, or provide any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will suspend the account immediately from circulation and participation and seek to close the account permanently deleting all information and contributions from the user. If any user has information that may identify any user as a person under the age of 13, please report this via abuse links through the site, or contact Exling through help or support links in the footer of our website.
Parental Rights and Minors. Regional binding laws will vary for definition of a 'minor'. This policy requires the user to be aware of their regional binding laws for this definition. All users between the age of 13, AND within the definition of a minor, are strongly recommend that to ask their parents for permission before sending any information about themselves to anyone over the Internet and we encourage parents to teach their children about safe internet use practices. 2. Data Provided to Exling
Personal Information. When you create an account for Exling you provide us with your name, date of birth, a contact email address outside of Exling network, gender, your native language, answers to security questions, and generalized information about your location. This information is required and part of the functionality of our site. The user may also have the opportunity to share additional profile information, such as resumes, schools attended, pictures, names and friends or family, relationships to other users, political status or views, religious affiliations, participation in organizations and groups, interests, full contact information if desired, and a variety of other information that enhances the ability of the user to be found by other users. After your account is created, each user is able to visit and edit your profile at any time to manage any information shared about yourself.
Accessibility of personal information.Some of the information provided will have options for the manner in which the information is available to the general public or accepted friends and family only. Each user is encouraged to choose these settings carefully while recognizing that sharing information that the user deems acceptable is a notable use of Exling products and may enhance the ability to be located by other users.
Contributed Information and Activity.We may retain the details of transactions and contributions you make on Exling. This information is stored for corporate awareness of account activity vs. Inactivity for database data management, the ability to like or dislike content, statistics for each user to view, total the numbers of friends and associations for users and groups, and for general overall improvement purposes of Exling. For example, if Exling discovers that one topic or area of our site is highly active it will allow our development team to explore creation of additional content for these users to enjoy.
Friend Information.We allow each user tools to import information from other networks as an integration tool of Exling. Each user may invite your contacts who do not have Exling to encourage them to join, and also use Instant Messenger functions between networks as defined. It will be the user's decision to share this information to Exling.
Location and Proximity.During a post, comment, or other contribution of content by the user a general proximity (state/province, and country) of your location from your profile and native language and dialect are stamped to the post. This information is part of what makes Exling content interesting and adds perspective to the comment. Your specific location is not tracked by Exling and any user should be cautious for sharing their full location to other users that they do not know.
Information about your Computer.
Website Cookies. The Exling websites will require login with username and password for participation. Your session is logged by a small piece of data called a "cookie". Your browser may allow or restrict the usage of cookies in various ways. To protect privacy information, and participate as a user, our program must temporarily store this cookie on your local machine to confirm that a user has authorized access to the site and the user account. Upon login, all activity will be associated with the user including all contributions of content. When the user is done it is requested that the user uses a formal 'logout' option. The click on this link will end the session formally and prevent further access under the previous login to our site. If the user is accessing from a device that is not theirs, it is highly recommended to take extra precaution to formally end the session with the 'logout' option. Otherwise, your session may be retained on the device that does not belong to you for a period of time. All cookies have set expirations so that users that become inactive for a period of time are logged off the network.
Content provided from 3rd party companies to Exling. Exling will make use of advertising partners as one method to keep the community a free service to end-users.
Some examples:
1) We will monitor the access to these links for interface to our advertising partners. This will allow Exling to monitor demographics to understand advertisement content effectiveness.
2) We will monitor the amount of traffic generated from various advertisements to ad partner websites to interface these partners and learn how effective this association has helped their business.
3) Exling may also collect information to learn which users have, or have not, seen ads posted with our site to help advertising partners reach the most broad audience possible.
Within a short period of time (90 days) after your activity with any advertisement, please note that your participation will become merely statistical data. Your name or contact will no longer be associated with this activity. Information for general demographics, total activity, and other information will be retained for our internal accounting and marketing team.
If any information, linked content, or content by 3rd party companies is viewed as offensive, inappropriate, or otherwise undesirable then please contact Exling support or help and report this to us immediately. Exling does not maintain 3rd party websites that may pay for advertisement on our site. Although we will review and try to empathise the position of all global users for any initial linked content to an advertisement, the 3rd party company can change this content upon their own decision or our team may not realize the positions of all users or the translated or implied meaning of 3rd party content. Please report any concerns, complaints, or abuse on this linked content immediately.
Information from other users. Exling may come to possession of information from you by other users of our site. For example, if a friend sends an invite to you from Exling, if you are tagged in a friends photo, or a friend mentions information in their submitted content. Please visit your setting for limiting which users can view your tags, or associations. If friends or other users are disclosing information about you without your permission, then please click the report abuse link on the comment or please report any incidents to Exling help or support submission forms.
3. Information shared to linked content or 3rd parties
All information submitted to Exling site and domain will adhere to our privacy policy. Linked content, 3rd party applications using the Exling API, and other 3rd party content is not bound by this policy. All users should review the terms of service, privacy policy, and practices of these companies on their own merit. Exling has no authority to legally bind a 3rd party company to our policy.
Sharing content to Exling. Exling is designed and set to allow the user's settings determine how to reflect your preferences on sharing your information that you submit.
- You can set the ability of the Exling site to hide and show information with the public or only users that you deem friends or family.
- Very limited details including your name, public profile photo, friends/associations, gender, language/dialect, general geographic region are required to remain publicly available, and therefore do not have privacy settings for your control. Your settings do allow the program to restrict 3rd party applications from finding or sharing information that is publically available outside of Exling network, but this information will be public at all times to registered Exling users even with this setting. Information that is shared outside the network publically may remain viewable and stored outside of Exling network even if your account is deleted or edited on Exling site. Please choose the information you share carefully and use caution for making these setting selections.
- Your recent posts, comments, or other contributions may be logged on friends or family pages so they may see what their friends are doing on Exling.
- Any information that you share may be duplicated by other users. It is important that all users use caution in sharing information that is not their personal property.
- Communication sent from each user can not be removed or deleted after sending. Emails once sent become property of the recipient account. Instant Messengers are logged by the recipient account, so this privacy policy rights for one user ends as the rights for another user begins. Exling is not able to remove postings or information from the recipient of shared information at the request of the sender or provider of this information.
- If you post any content on another user's pages that information will be subject to the other user's privacy-related settings and not your own settings. Similar to sending communication, this information becomes the property of the recipient as offered by the sender.
Public information Setting. Information that is publicly available information, may be accessed by anyone. It may be discovered by search engines, users not logged in and contributing to Exling, or to anybody with an internet connection. This information may be imported and exported by Exling also without privacy limitations. This setting may apply to some types of contributions by default. For example, commenting on a general news story or contributing in a sports discussion thread. This information is not provided to a specific user or group and would be subject to be a public post. It is possible that information posted publically could be associated with your identity and remain outside the realm of control of Exling.
Exling API. Exling does not own or operate 3rd party applications or websites that may utilize the Exling API to access our network. These sites require username and password to access any information. If the user provided their username and password to a 3rd party this implies that the user is making your Exling information available to someone outside the scope of this privacy policy and outside the control of Exling. The API may allow Exling to confirm the use of a user with a 3rd party API and provide feedback on the activity only. Prior to allowing a 3rd party to have access to our API we require this company to comply to terms that limit their use of your information and we allow the user settings to prevent 3rd party application access completely. Any violation by a 3rd party to our terms of privacy may only be reactionary to stop the activity from continuing, but may not limit the exposure of the misuse of a 3rd party application. Users that are concerned by this exposure should select to deny any 3rd party API from accessing their information completely. Users that leave this option open and also provide their username and password should be in full trust of the 3rd party application credibility, privacy policy, and integrity.
- You also can use your settings to limit which of your information your friends allow to be issued to 3rd party API programs.
- Exling will share and use data of birth, region, and language settings to help API programs distribute age-specific content, regional content, and content in specific languages.
If you find an application or website that violates our rules, you should report the violation immediately to us via abuse, help, or customer service communication options throughout our site.
Exporting Content. Our Exling service will allow each user to use exporting options to export information from their Exling account. Any information you have for your friends, or that your friends have about you, could be exported off of the network. Please use caution before adding a friend unless you are certain it is a person that you are comfortable to share your personal information posted on this site.
Ads. Some of our Advertising partners may wish to collect select demographical, information in addition to traffic about the users that traffic their site. Exling will provide this generalized statistical information at their request. This information does not include contact information for them to reach you by phone, by post office mail, or other methods.
Links. Clicking on links anywhere through Exling sites you redirect you to content off of our site. This information will typically open in another browser window. We are not responsible for the privacy practices of other sites, and we encourage you to read their privacy statements before sharing any information about yourself.
4. Exling usage of your information.
Our intention with using information off of the Exling site will include the following purposes:
To manage and optimize service.Exling may use or collect information through the usage of Exling services and features to you in order to quantify activity, improve content, and manage the site efficiency. Our customer service may also have select information from your profile shared to them upon any communication sent to help, customer service, or reporting abuse submissions to help our team to reply back to you. We may also use Exling database information to prevent potentially illegal activities, and to enforce our Terms of Service agreement. For example, we may ask your region to deliver regional advertisement, news content, and weather. Exling may also use automated systems to track and monitor information that might be abuse of our service or offensive to our network of users. An example of this might be a user that is continuously posting information all over our site to promote a 'stock tip', as a method of collecting money for some organization that might be legitimate, or 'prescription drug' promotion. These efforts may on occasion result in a temporary or permanent suspension or termination of some functions for some users for any questionable activity.
Contacting You. Exling may use your contact information to update you to any changes in policy, alerting you as defined in your user settings, in reply to any customer service/abuse/help claim, or other similar activity. We also have a setting to opt out of periodic updates from our network for new services and content. These default settings will send notices to you to stay aware of our latest features and areas of our site.
Personalized Ads. Exling does not share information without your permission to 3rd party advertisers; however, an advertiser may wish to target their Ad to a specific language, age range, and geographical location that their product/service is available. The advertiser would select these criteria and may have some statistical data to our overall number of users that fits their specifications, but would not receive contact information, names, or other information from Exling.
Social Notifications.
Suggesting Contacts. Your profile information may be used in making suggestions to you and other users of Exling to locate friends and people they know. If you want to limit your visibility in suggestions we may limit the searches from suggesting you for less than an exact match of search criteria. We also have settings to allow specific users to not be suggested to you, so once you review the content and confirm you don't know this user, that it will not be suggested repeatedly to you.
Downloaded Software. Exling provides specific software available for download by the user. Browser toolbars, IM applications, and other up loaders may transmit data to us. Exling downloads will be hosted on Exling websites for file download and will provide terms of function and descriptions for function. Your information on these applications will follow and make specific mention to compliance with Exling's privacy policy
Deceased Users. If Exling is informed from help, customer support, or abuse that a user is deceased, we will follow the family's requests for the continuance of a page. Until we are aware of the status change, the page and login will remain active. Family member's may choose to keep the wall for the user open so other family can continue to remember their loved one with memory postings & remember important dates associated with their loved one, or they can provide us information on the death of their family member so we may formally close the account for this page.
5. Information Sharing Methodology
The purpose of Exling is to provide an infrastructure of multi-lingual communication methods and integrating software for communication networks. The purpose of this product is to distribute and share information with people you would like to associate, while restricting the access and misuse of this information by people you do not authorize access.
Invite a Friend. If you click to invite a friend to Exling and share their email, we will send your friend a message mentioning your name and some highlights of our site's function. We also may send a couple additional reminders following the initial request if they don't follow the initial link or email, or if they don't click to deny the request. If your friend denies the request, then we will not continue to solicit them to join the Exling network.
Your Optional Information Sharing. If at your option you select to share information to advertisers, 3rd parties, or other locations outside of the Exling control and privacy policy it is completely at your discretion. Exling will default settings to avoid any accidental sharing of information. If an application requests you to change a setting, share specific information by form or control menu pop-up, please use caution in your decisions to open these settings.
Finding People. Specific information will be publically available to network users to help people you know find and request to interact with you on Exling network. This information may include schools you attended places you share that you work now or previously worked, groups or organizations that you belong to, and others. You may control via settings if your profile is suggested to other users, but a direct search of these profile attributes is key to the ability to find people and is not completely restricted by any setting.
Off-Network Searches. We will limit the information available to 3rd party applications, search engines, and other programs unless they have your username and password. Some information will be available off-network including public posts by all users. If a news organization wants to find the global comments of a public story, then our comments may be publically available to search engines, indexing, and stored off-site. Your personal wall, friends wall, blog, and discussion threads created can be set to now be found by outside networks.
Exling corporate sharing. Exling reserves the right to share demographic or generalized information about the use of Exling site for purposes of determining marketing strategies, promotion, improvement of the site, and other reasonable business development. Exling will not disclose any information about specific users profiles, contact information for users, or other details of specific user activity to any 3rd party. This information will be more generalized to determine larger trends in usage in different areas and demographics to improve the success and usage of our site.
Transactions through Exling. At the option of the user, a specific activity may seek you to share information. For example, if you click to receive more information. If you select this option at your own discretion then specific exling contact details may be sent to the identified recipient. Once this information is shared, they will have your contact information. Please choose carefully any party you are sending your contact information to ensure that they are reputable.
Sharing demographics to Advertisers. Clicking on advertisements is a source of funding for the Exling site. We encourage users to participate in sponsor ads, and we provide some data back to advertisers to see the value of advertising with us. Demographics of the users that click on ads may be shared with advertisers including language, regional location, age groups, number of clicks on the advertisement. No specific information for soliciting our users would be shared.
Cooperative Services. Exling may have some situations that Exling corporate is cooperating to help an organization, company, or other effort worldwide to help recruit people that are interested. In this instance, your optional participation, may require us to access information from your account for the selected service and you will be asked specifically to authorize the providing of information.
Legal Requests. At the request of court orders, subpoenas, or other formal and official requests by a legal body (including criminal and civil matters) Exling will share information when required by law. Exling has headquarters outside the USA, but these requests will also be honored with jurisdictions outside of the United States if Exling believes that it is required by law and applicable to the user by the jurisdiction of the requesting body, and reasonable and compliant for international methods for legal matters. Exling may also at our discretion share information, contact authorities with applicable jurisdiction, or otherwise assist law enforcement when we have believe that illegal activity is being facilitated through our site, similar illegal activity is reported by other users, or comes to our attention by any source. This includes, but is not limited to, communication for the sale or solicitation of illegal goods/services, illegal or inappropriate communications with a minor (age may vary by regional jurisdiction), threats or reports of acts that might cause harm to a person, or group of people, or any violent act that threatens harm.
Transference of Exling property. Should the event occur that Exling property be sold, merged, or ownership changed in any way this privacy policy will remain valid for all information provided prior to the change in ownership. Any change in privacy policy thereafter by a new organization management will require a formal submission of terms and acceptance by each user upon login to our network. In such an event, all users would have a terms and conditions pop-up upon login that defined any changes and requested acceptance.
6. Changing and Removing Information or Data.
Profile Changes. The user at any time may enter the profile settings and edit or remove any offered information. Date of birth and some settings will not allow change after initial account creation.
Deleting and Removing Contacts. <>
Ending your Account with Exling. Through your address book, each user may remove or delete contacts from friends/family listings. This will prevent users from future access to your personal information and posts.Your account with Exling for posting information is voluntary. Any user may choose in your profile to discontinue service at any time. Simply follow the links to discontinue service and your account will become unavailable for other users to access. Discontinuing service may result in Exling holding your profile data on our servers (unavailable to other users) for up to 30 days. Restoration of your full account would be possible should you change your mind on this decision to stop service within this period of time, and your ability to reclaim your username will be possible for a period afterward. If you select to completely delete the account, then all information stored in your profile including photos and other information will be deleted. Please note that even deleting your account may not erase historic transactions, comments, and other information stored on other user's profiles, public stories, and other locations for a longer period of time and all historic posts will be associated to an 'Unknown User' in all forums. Your username will be isolated from any new users for a period of time to avoid any potential identity theft, and should you wish to restore your account.
Exling Database. Anything deleted from view at any time may remain in Exling database for a period of up to 90 days following the post even with deletion of the content.
Information for individuals not on Exling. If a user at any time provides us contact information for referral or any reason for a potential user of Exling, it will be stored within our records for a period of time. If the person denies the requests, we will not continue to provide unsolicited emails or requests to that person. However, this will be applicable to each time the user's information is provided. The system is automated and each time a new potential user is identified it will seek contact with this person until the request is denied and may be reminded a few times of the invite following the initial email. Any individual outside the network may request to be removed from a current solicitation. This will not prevent future instances of friends inviting you via the Exling network. The invites are not unwarranted solicitations by Exling company, but acquaintances individually asking that you join Exling network to socialize with them.
7. Protecting Information
Securing Information. Exling stores it's database on a server behind a firewall and each account requires a username and a password to access the database for that user's information. We also implement the ability for all users to be watchdogs for us to quickly identify and extinguish inappropriate users from targeting our network. Any reported inappropriate behavior we take seriously and try to remove from participation on our platform.
Reasonable Risk. Exling takes all reasonable measures to protect our information from sources internal and external, but no system is without risk of exposure. It is possible that individual users may share information about you that you do not want public. It is possible that somebody could crack a password to match your username or a person within your circle of friends to access information about you. There is no guarantee by Exling that information shared could not get exposed or become publically available. Exling is also not responsible for 3rd party API programs with access to Exling that might not hold as strict privacy policies and practices and might provide additional risk to any information.
Good Practices for your Privacy. Each user can take reasonable measures to minimize your risk of breach in privacy. Some suggestions from Exling include development of a password that contains letters, numbers, and even symbols and is reasonably complex. It is suggested to change your password periodically to avoid exposure over time to somebody attempting to decode your password. Inform your friends and family so they are also informed on the importance of updating their passwords and keeping strong complexity to their passwords. We also suggest that users do not follow a common password practice for more than one account. It is important to not use the same password for multiple accounts, nor using a common system for passwords that would be easy to decrypt like website123 for all sites you use as it would be easy to guess Exling123 for this site if this system of passwords became compromised. In this situation, a single breach in privacy can quickly become a major breach in privacy.
Report Violations . You also have a part in defending your privacy and the privacy of others. Should you observe any behavior, activity, or abuse of Exling, please report it. There are links to report abuse throughout the site, contact options at the bottom footer of the site, and support chat options to report this type of behavior. Please use them for anything suspicious.
8. Other Terms
Changes. The privacy policy is subject to change. A change in the policy will require your acceptance, and if changed, would present a window for your viewing and confirmation. Unless a formal change is required to the policy, Exling policy is applicable to all information on our network until further notice.
Consent. You, the user, consent that information you are submitting is being shared to Exling, LLC a company with headquarters and operating under the laws of the United States of America.
